102620093(903) Please be advised that Mr. Chiarelli requested
that, a lawyer in the legal department of the City of Ottawa review your
file. The lawyer has advised as follows: 1.
You received rental income (from 7
apartment units in Montreal for the period January 1995 to July 1995) but
that you did not realize that you were obligated
to declare the rental income because it generally went to expenses for the
units. 2. The notes and
correspondence in your file indicate that in August of 1995 a City of
Ottawa social assistance worker explained to you the policy that all
income, including rental income, needs to be reported and 3.
You acknowledged to the City of Ottawa
social assistance worker that there was accordingly an
"Overpayment" of social assistance benefits to you for
the period January 1995 to July 1995. 4.
On October 27, 2003 a letter was sent to
you from Allyson Downs of this office. The said letter provides the details
of the Overpayment Calculation and indicates the
Overpayment Amount as $6,007.55. A copy of the said letter is enclosed. The lawyer noted that you have not been charged any
interest on the amount that is owed, $6,007.55. The lawyer has provided Mr. Chiarelli
with an opinion that "the City of Ottawa has no jurisdiction or
authority to cancel or to forgive the overpayment
of financial assistance that Mr. Chisholm received in 1995." At this time the City of Ottawa is prepared to
accept repayment of the amount owed by monthly payments of $75.00 if you provide a minimum of twelve post dated cheques with
the first payment to commence on December 15, 2005. The cheques must be
sent to: Carole Sherman, City of
Ottawa Revenue Office, Overpayment Recovery Unit Box 3442 Station D, Ottawa KIP
